1.0 About Our Gift Card Program:
1.1 Although the card says "Gift Card" on it, some cards act as true Gift Cards (herein referred to as 'Gift Cards'), and others act as Gift Certificate Coupons (herein referred to as 'Gift Certificate Type Cards') for promotional purposes.

1.2 Cards that are true gift cards (Gift Cards), for example, cards that someone purchased as a gift for someone, never expire. And in the case of refunds, funds are refunded to the Gift Card (policies on cancellations, reschedules, and refunds still apply).

1.3 Cards acting as a Gift Certificate Coupons (Gift Certificate Type Cards), for example a card donated to an organization as a door prize, or prize donated as a token of appreciation, will have an expiry date. In the case of a cancellation, refunds will not be issued to the card. IE. Once the Gift Certificate Coupon is used, it's gone.
2.0 Terms and Conditions for Cards acting as Gift Cards:

2.1 Avalon Motorsports Inc is not responsible for lost or stolen cards.

2.2 Card should be treated as cash.

2.3 Card cannot be redeemed for cash.

2.4 Card value is in Canadian currency.

2.5 Avalon Motorsports Inc makes no warranty regarding any good or service you may receive in connection with you use of this card.

2.6 Avalon Motorsports Inc assumes no responsibility and shall not be liable for any injury, loss, or damage of any type or nature which arises out of your use of card and/or the performance of any third party provider.

2.7 The card must be redeemed at avalonmotorsports.ca or by calling 747-1080 or for those outside the local St. John's calling area call toll-free at 888-747-1080. Any unused balance will be retained on the Gift Card for future use.

2.8 Redeemable online at avalonmotorsports.ca ; these terms and conditions are subject to change without notice.

2.9 The Gift Card may be used as partial payment on Avalon Motorsports Products and Services, with the remaining amount owing to be paid immediately by other acceptable payment methods. At no time is the entire amount on the Gift Card required to be used in one transaction, the unspent amount will be available for future use (the “Balance”).

2.10 Information about the Gift Card can be obtained by contacting Avalon Motorsports. You must have your Gift Card number available and proof of your identity may be required.

2.11 Gift Cards do not have any cash or surrender value and are not redeemable for cash.

2.12 All purchases using a Gift Card are subject to any applicable Avalon Motorsports Refund Policies.
2.13 Avalon Motorsports reserves the right to correct the Balance of the Gift Card if Avalon Motorsports believes that a billing error has occurred. Avalon Motorsports disclaims all liability for any such billing errors. The decision of Avalon Motorsports is final.

2.14 Avalon Motorsports Inc reserves the right not to be responsible for any Gift Cards that are lost, stolen, destroyed, altered or used without permission.

2.15 Avalon Motorsports will not honor and has the right to take possession of and cancel any Gift Cards that are unlawfully acquired or used.

2.16 Any dispute arising from the purchase and use of Gift Cards will be resolved between Avalon Motorsports and the purchaser and/or user of the Gift Card and failing that, then be arbitrated and finally resolved by a single arbitrator. Purchasers and users of Gift Cards waive any and all rights to commence or participate in any legal action against Avalon Motorsports.

2.17 Gift Cards and their use are subject to the Avalon Motorsports Privacy Policy. Your ownership rights in your Gift Card are limited solely to the physical media comprising your Gift Card. Avalon Motorsports retains all rights, title and interests in any word or design marks and any other information which may be displayed, incorporated, embedded or encoded in or on your Gift Card which includes, but is not limited to the Avalon Motorsports Logos.

3.0 Terms and Conditions for Cards acting as Gift Certificate Coupons:

3.1 Use of gift certificate card constitutes acceptance of the following terms and conditions:

3.2 This certificate type card is not replaceable if lost or stolen and should be treated as cash. Neither Avalon Motorsports Inc nor any channel partner nor any value added reseller is responsible for loss, theft or mutilation of this certificate type card.

3.3 Face value of certificate type card is in Canadian Dollars. Unauthorized resale will invalidate this certificate.

3.4 When properly authorized, this certificate type card may be redeemed for goods and services at avalonmotorsports.ca or by calling Avalon Motorsports Inc at 747-1080 or toll free at 888-747-1080.

3.5 Gift certificates are subject to the expiration date.

3.6 Neither Avalon Motorsports Inc nor any channel partner makes any warranty of any kind regarding any service you may receive in connection with your use and redemption of this certificate type card.

3.7 Gift Certificate Type Cards can be redeemed up to the value of the card, however, unused portions are not retained on the card. Use of the card to redeem any amount voids the card from any future use.

3.8 Redeemable online at avalonmotorsports.ca ; these terms and conditions are subject to change without notice.

3.9 Information about the Gift Certificate Type Card can be obtained by contacting Avalon Motorsports. You must have your Gift Certificate Type Card number available and proof of your identity may be required.

3.16 Any dispute arising from the use of Gift Certificate Type Cards will be resolved between Avalon Motorsports and the card holder. Failing that, the decision of Avalon Motorsports will be final. Users of Gift Certificate Type Cards waive any and all rights to commence or participate in any legal action against Avalon Motorsports.

3.17 Gift Certificate Type Cards and their use are subject to the Avalon Motorsports Privacy Policy. Your ownership rights in your Gift Certificate Type Card are limited solely to the physical media comprising your Gift Certificate Type Card.   Below are general policies of Avalon Motorsports as applies to registration for motorcycle training regardless of method of payment.

  Cancellation / Reschedule Requests
 

We require 48 hours notice, for reschedule requests, or cancellation requests. If we have 48 hours notice, we can accommodate the reschedule request or cancellation request. As an example, if your classroom session starts 7pm on Friday, we need to know by 7pm Wednesday if you can't make it.

If you are unable to give us 48 hours notice, give us as much notice as possible. We may be able to get someone from a later course to take your place. If we can't get someone to switch with you, then you would be out any money paid for the course.

Your cancellation or reschedule notice has to be received via one of the following methods before the 48 hour deadline, and a confirmed received by Avalon Motorsports, before you assume you are rescheduled or cancelled:

-> By faxing the request to 709-747-1978,

Unless you hear back from us, do not assume your request has been received.

   
  NO Shows 
  If you are scheduled for a course, and you don't show up, you loose any money paid for the course. We've had plenty of students tell us they were at the hospital, or they had to work, or they forgot about it, etc. etc. Every space in the seat has to be a paid seat. If you just don't show up, we will not be able to 'fit' you in later without you re-paying for the course.
   
  Progressive Competence  
  Not everyone can ride a motorcycle, but fortunately doing to motorcycle course is a great way to determine if motorcycling is your sport. Look at it this way, better to spend a few hundred on a motorcycle course, than it is to go out and spend thousands before you find out if the course is for you. During your on bike training we need to see progressive competence, which means the following:
  The Avalon Motorsports Basic Rider Course is designed for the complete novice. We begin with braking and balancing skills (without the engine running); the student will have to achieve a certain competence with these non-powered exercises before we move on to exercises under the power of the engine. While we make every effort to make sure everyone moves on to the powered exercises, it is possible and has happened before that the student will not achieve the competence to move ahead with the course. In cases where the student is not ready to move on, unfortunately they do not complete the course, and in such cases there is no refund. This policy is intended for the safety of the student and for the safety of other students on the course.

Also, once the student moves on to the “powered” exercises (exercises with the engine running) they may develop certain bad habits that are quite dangerous. We will make every effort to correct these bad habits allowing the student to continue with training. However, occasionally we have students who, no matter how many times we tell them about the bad habits, they don’t make the necessary adjustments to break those bad habits. In these cases we’ll have to end that student’s training in the interest of that student’s safety and the safety of other students on course.

Also, for the students that continue with all the training, those students will have to pass a motorcycle skills test to receive their certificate. Our skills test indicates whether the student can safety operate the motorcycle on the street; we test things like: Can the student stop at a predetermined point? Can they negotiate a tight turn? Can they stop quickly and safely?

Also, it is possible that during the training the student may sustain an injury requiring medical attention, which may include transport by ambulance to hospital to be seen by a physician. In this instance, the student will likely “miss out” on some exercises. In this instance, the student would not be able to continue due to the missed lessons.

While we do have a high success rate; we usually only have one or two training sessions where students do not complete the course; it is possible that a decision will have to be made as described above. 
   
  Protective Riding Gear 
  Students are required to supply their own protective riding gear.

Helmet - Sturdy Jacket - Sturdy Pants - Gloves - Boots (that cover the ankle) - Eye Protection

DOT is not a recognized helmet approval in Newfoundland and Labrador, however, if you sign the waiver, and if in the opinion of the instructors the helmet is in good condition (not too old or damaged), we will allow the DOT approved helmet.

Bring your riding gear to the classroom so the instructors can check it. If you show up on course and an item isn't satisfactory, you will not have time to source replacement riding gear, and you will not be able to continue, won't be rescheduled, and won't receive a refund.

It's in everybody's interest to have their gear checked at the classroom.
